5. Social media

Social media elements with Shariff

This website uses elements of social media (e.g., Facebook, X, Instagram, Pinterest, XING, LinkedIn, Tumblr).

You can usually recognize the social media elements by the respective social media logos. To ensure data protection on this website, we only use these elements together with the so-called „Shariff“ solution. This application prevents the social media elements integrated on this website from transferring your personal data to the respective provider when you first visit the page.

Only when you activate the respective social media element by clicking the associated button is a direct connection to the provider’s server established (consent). As soon as you activate the social media element, the respective provider receives the information that you visited this website using your IP address. If you are simultaneously logged into your respective social media account (e.g., Facebook), the respective provider can assign the visit to this website to your user account.

Activating the plugin constitutes consent within the meaning of Article 6(1)(a) of the GDPR and Section 25(1) of the TDDDG. You can revoke this consent at any time with effect for the future.

The use of the service is carried out in order to obtain the statutory consents for the use of certain technologies. The legal basis for this is Art. 6(1)(c) GDPR.

Facebook

This website includes elements of the social network Facebook. The provider of this service is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. However, according to Facebook, the data collected is also transferred to the USA and other third countries.

An overview of the Facebook social media elements can be found here: https://developers.facebook.com/docs/plugins/?locale=de_DE.

When the social media element is active, a direct connection is established between your end device and the Facebook server. Facebook thus receives the information that you have visited this website using your IP address. If you click the Facebook „Like“ button while logged into your Facebook account, you can link the content of this website to your Facebook profile. This allows Facebook to associate the visit to this website with your user account. Please note that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Facebook. For more information, please refer to Facebook’s privacy policy at: https://de-de.facebook.com/privacy/explanation.

The use of this service is based on your consent pursuant to Art. 6(1)(a) GDPR and § 25(1) TDDDG. The consent can be revoked at any time.

As far as personal data is collected on our website using the tool described here and forwarded to Facebook, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland are jointly responsible for this data processing (Article 26 GDPR). In this case, the joint responsibility is limited solely to the collection of the data and its forwarding to Facebook. The processing carried out by Facebook after forwarding is not part of the joint responsibility. The obligations shared by us have been set out in a joint processing agreement. The text of the agreement can be found here: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing the privacy information when using the Facebook tool and for implementing the tool in a data protection-compliant manner on our website. Facebook is responsible for the data security of the Facebook products. Affected rights (e.g. requests for information) regarding the data processed by Facebook can be asserted directly with Facebook. If you assert the affected rights with us, we are obliged to forward them to Facebook.

Data analysis by click-and-tap

When we send newsletters using click-to-tap technology, we can determine whether a newsletter message has been opened and which links have been clicked, if applicable.

The click-tap feature also allows us to segment newsletter recipients based on various categories (so-called tagging). For example, newsletter recipients can be divided according to gender, personal preferences (e.g., vegetarians or non-vegetarians), or customer relationships (e.g., customer or potential customer). In this way, newsletters can be better tailored to the respective target groups. For more information, please see: https://www.klicktipp.com and https://support.klicktipp.com/.

If you do not want to receive an analysis by clicking on the link, you must unsubscribe from the newsletter. We provide a corresponding link in every newsletter message for this purpose.

Legal basis

Data processing is carried out based on your consent (Art. 6(1)(a) GDPR). You can revoke this consent at any time. The legality of the data processing operations that have already taken place remains unaffected by the revocation.

The United Kingdom is considered a third country that is more secure in terms of data protection law. This means that the United Kingdom has a level of data protection that corresponds to the level of data protection in the European Union.

Storage duration

The data you provide to us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter, either with us or with the newsletter service provider. After unsubscribing from the newsletter, the data will be deleted from the newsletter distribution list. Data that has been stored with us for other purposes remains unaffected by this.

After you are removed from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist, if this is necessary to prevent future mailings. The data from the blacklist will only be used for this purpose and not combined with other data. This serves both your and our interests in complying with legal requirements regarding the sending of newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). The storage in the blacklist is not time-limited. You can object to the storage if your interests outweigh our legitimate interest.

For more information, please refer to the Klick-Tipp privacy policy at: https://www.klicktipp.com/datenschutzerklarung/.

We have concluded a contract for the processing of orders (AVV) for the use of the aforementioned service. This is a contract required by data protection law that ensures that this service processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Newsletter delivery to existing customers

If you order goods or services from us and provide your email address when doing so, this email address may subsequently be used by us for the sending of newsletters, provided that we have previously informed you of this. In such a case, only direct advertising for similar goods or services will be sent via the newsletter. You can unsubscribe from this newsletter at any time. A corresponding link can be found in each newsletter for this purpose. In this case, the legal basis for sending the newsletter is Art. 6(1)(f) GDPR in conjunction with § 7(3) UWG.

After you are removed from the newsletter distribution list, your email address may be stored by us in a blacklist to prevent future mailings to you. The data from the blacklist is only used for this purpose and not combined with other data. This serves both your and our interests in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Article 6(1)(f) GDPR). The storage in the blacklist is not time-limited. You can object to the storage if your interests outweigh our legitimate interest.

Post advertising

We use your address in accordance with all legal regulations for the dispatch of postal advertising (postal advertising).

The legal basis for this is our legitimate interest in direct advertising pursuant to Art. 6(1)(f) in conjunction with Recital 47 of the GDPR. If appropriate consent has been requested, processing will take place exclusively on the basis of Art. 6(1)(a) GDPR; consent can be withdrawn at any time. More specific regulations may be provided to you as part of the data collection process and take precedence over this policy.

Your address remains with us until the purpose for data processing no longer applies. If you make a legitimate request to delete your data or withdraw your consent to postal advertising, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g., tax or commercial retention periods); in the latter case, the deletion will take place upon the lapse of these reasons.

We use the following service provider for the shipping of our postal mailings:

Deutsche Post AG
Charles-de-Gaulle-Str. 20

YouTube with expanded privacy protection

This website embeds videos from the website YouTube. The operator of the website is Google Ireland Limited („Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of these websites that include YouTube, a connection is established with YouTube’s servers. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.

We use YouTube in expanded privacy mode. Videos that are played in expanded privacy mode are not used by YouTube to personalize browsing on YouTube. Ads that are played in expanded privacy mode are also not personalized. In expanded privacy mode, no cookies are set. Instead, so-called local storage elements are stored in the user’s browser that, similar to cookies, contain personal data and can be used for recognition purposes. Details about expanded privacy mode can be found here: https://support.google.com/youtube/answer/171780.

If necessary, after activating a YouTube video, further data processing processes may be triggered, over which we have no influence.

The use of YouTube is carried out in the interest of presenting our online offerings in an appealing manner. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR. If appropriate consent has been requested, the processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s device (e.g., device fingerprinting) within the meaning of TDDDG. The consent can be revoked at any time.

Further information about data protection at YouTube can be found in their privacy policy at: https://policies.google.com/privacy?hl=de.

The company is certified under the „EU-US Data Privacy Framework“ (DPF). Google Fonts

This page uses so-called Google Fonts to uniformly display fonts. These fonts are provided by Google. When you visit a page, your browser loads the required fonts into its browser cache to display text and fonts correctly.

For this purpose, the browser you use must establish a connection to Google’s servers. This enables Google to know that this website was accessed using your IP address. The use of Google Fonts is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the uniform presentation of the font on its website. If appropriate consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.

If your browser does not support Google Fonts, a standard font from your computer is used.

The provider of this page has no influence on this data transmission. When Google Maps is activated, Google can use Google Fonts for uniform display of fonts. When you call up Google Maps, your browser loads the required web fonts into its browser cache to display text and fonts correctly.

If consent has been requested, the use of the relevant tools is based on this consent; the consent can be revoked at any time with effect for the future.

Storage duration

The data directly collected by us through the video and conference tools is deleted by our systems as soon as you request us to delete it, revoke your consent to its storage, or the purpose for data storage no longer applies. Stored cookies remain on your device until you delete them. Compulsory statutory retention periods remain unaffected.

Handling applicant data

We offer you the opportunity to apply to us (e.g. by email, post or via the online application form). In the following, we inform you about the scope, purpose and use of the personal data collected as part of the application process. We assure you that the collection, processing and use of your data is carried out in accordance with applicable data protection law and all other legal regulations, and that your data will be treated strictly confidentially.

Scope and purpose of data collection

When you submit an application to us, we process the personal data associated with it (e.g., contact and communication data, application documents, notes during job interviews, etc.), insofar as this is necessary for deciding whether to conclude an employment contract. The legal basis for this is § 26 BDSG under German law (initiating an employment relationship), Art. 6(1)(b) GDPR (general contract initiation), and – if you have given your consent – Art. 6(1)(a) GDPR. Your consent is revocable at any time. Your personal data will only be shared within our company with individuals involved in processing your application.

After that, the data will be deleted and the physical application documents destroyed. The storage serves, in particular, for evidentiary purposes in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period has expired (e.g., due to an impending or ongoing legal dispute), a deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your consent (Article 6(1)(a) GDPR) or if statutory retention obligations preclude deletion.

Admission to the applicant pool

If we do not offer you a job, there is the possibility of including you in our applicant pool. In the event of acceptance, all documents and information from the application will be added to the applicant pool in order to contact you in the event of suitable vacancies.

Admission to the applicant pool takes place solely on the basis of your express consent (Art. 6(1)(a) GDPR). The consent is voluntary and is not related to the ongoing application process. The person concerned can revoke their consent at any time. In this case, the data from the applicant pool will be deleted irrevocably, unless there are any legal reasons for retaining it.

The data from the applicant pool will be deleted irrevocably no later than two years after consent is granted.
