Allgemeine Gesch\u00e4fts\u00adbedingungen<\/strong><\/h2>\n\n\n\n


Section 1 Scope of application<\/strong> These General Terms and Conditions apply to all offers and services provided by Roman Drozd aka DJ Roman White. Individual agreements in the respective offer or contract take precedence over these General Terms and Conditions. Any deviating or additional agreements must be in writing, unless expressly agreed otherwise. <\/p>\n\n\n\n

Section 2 Conclusion of the contract<\/strong> A contract is concluded by accepting an offer or by a corresponding order confirmation. Acceptance can be made in particular by signing the offer or by a clear confirmation in text form, for example by e-mail. The nature, scope, venue and duration of the agreed services are determined by the respective offer. <\/p>\n\n\n\n

\u00a7 3 Prices and payment<\/strong> The prices and payment terms agreed in the respective offer apply. The payment method, payment deadline, and, if applicable, agreed advance payments result from the respective offer. Additional services or additional costs not included in the offer that arise due to subsequent changes or incorrect information provided by the client may be invoiced separately after prior agreement. Costs incurred in connection with the implementation of the event, in particular local taxes, artist social security contributions (KSK), or GEMA fees, shall be borne by the client, unless the offer states otherwise. <\/p>\n\n\n\n

\u00a7 4 Organization of the event<\/strong> The client ensures that the spatial and organizational conditions necessary for the agreed performance are available in a timely manner. These include, in particular, a suitable venue and timely access to the event venue. Required access passes, parking facilities, accreditation or admission tickets must be made available by the client in a timely and free of charge manner. Delays, waiting times or changes in schedule that are not attributable to Roman Drozd or the artists or service providers employed by him do not reduce the agreed remuneration. To the extent necessary for the performance of the event, the client provides adequate catering and non-alcoholic beverages for the artists and service providers employed. The specific musical and artistic arrangements are within the framework of the agreed event and any previously agreed musical specifications, at the artistic discretion of Roman Drozd and the artists involved. <\/p>\n\n\n\n

Section 5 Liability<\/strong> According to the legal regulations, Roman Drozd is liable for damages caused intentionally or through gross negligence. The statutory liability provisions also apply to damages resulting from the violation of life, body or health. In the case of slight negligence in the breach of essential contractual obligations, the liability is limited to the typical and foreseeable damage of the contractual type. Essential contractual obligations are those whose fulfillment first and foremost enables the proper performance of the contract and the client may regularly rely on their compliance. Roman Drozd is not liable for technology, premises, areas, power supply or other facilities provided by the client, the location or third parties, insofar as their nature or functionality does not fall within its sphere of responsibility. The client ensures that the event venue is suitable for the agreed-upon performance and that the necessary regulatory permits are in place. Any performance disruptions should be reported immediately to Roman Drozd so that remedial action can be taken if possible. <\/p>\n\n\n\n

\u00a7 6 Withdrawal and cancellation by the client<\/strong> The client may withdraw from the contract before the agreed event date. In the event of a cancellation, the following cancellation costs based on the agreed remuneration will be due: \u2013 up to 6 months before the event begins: 30 % \u2013 less than 6 months up to 3 months before the event begins: 50 % \u2013 less than 3 months up to 30 days before the event begins: 75 % \u2013 less than 30 days before the event begins: 90 % The client is expressly permitted to provide proof that Roman Drozd caused no or a significantly lower amount of damage. Already provided services as well as proven costs incurred and no longer refundable can be calculated additionally, provided that these have not already been deducted from the aforementioned cancellation costs. The date of cancellation is determined by the receipt of the cancellation notice. <\/p>\n\n\n\n

\u00a7 7 Force majeure and other performance barriers<\/strong> If an event that neither party is responsible for and that could not have been foreseen at the time of the conclusion of the contract cannot be carried out or is not carried out as agreed due to an event that is not attributable to any of the parties, the statutory provisions apply. In such a case, the parties will, as far as possible, agree on the matter as early as possible and consider whether a reasonable relocation or other mutually agreeable solution is possible. The parties\u2019 further rights under statutory provisions remain unaffected. <\/p>\n\n\n\n

\u00a7 8 Final provisions<\/strong> Changes and additions to individual agreements can be made, in particular, in written form. Should any provision of these General Terms and Conditions be wholly or partially invalid, the remaining provisions hereof shall remain unaffected. The invalid provision shall be replaced by the statutory provisions. The law of the Federal Republic of Germany shall apply insofar as such choice of law is legally permissible. <\/p>\n\n\n\n
